LEGAL DISCLAIMER:

By signing this agreement, you give up the right to sue for any injury or damages, Howsoever caused, Scuba Shop, who operates in Honduras (hereinafter referred to collectively as “Scuba Shop.”) and owners, employees, representatives, officers, and agents (hereinafter referred to collectively as “Employees”). I, hereby sign this agreement on behalf of myself, my child, my personal representatives, heirs, and assigns.

REGARDING NEWSLETTERS AND SUBSCRIPTIONS:

You agree that subscriptions are set to auto-renew by default. You can cancel your subscription at any time with a written notice. Newsletters are sent out periodically. You can opt out and back in at any time.

REGARDING ACTIVITIES AND EXCURSIONS

1. I agree as a precondition to my participation in an animal viewing or a petting zoo or field trip or Spend the Day, Birthday Party (hereinafter referred to collectively as The Event”) event organized by Scuba.Shop and or its Employees, conducted by the Scuba Shop or its Employees, and in further consideration of Scuba.Shop allowing me to do so, to be strictly bound by the terms of this Waiver, Assumption of Risk and Indemnity Agreement (hereinafter referred to collectively as “This Agreement”)

2. I acknowledge that animal encounters and petting zoo activities involve inherent risks that may cause serious injury and possibly death to participants.

3. I fully understand the risks and dangers associated with my child’s (or my personal representative, heirs or assigns) participation, in The Event, and accept same entirely at my own risk.

4. I hereby waive any and all claims, which I may have against Scuba.Shop, and/or its Employees, and release Scuba.Shop and its Employees from all liability for injury, death, property damage, or any other loss sustained by me or my child (or the child I am representing) as a result of my/their participation in the Event, due to any cause whatsoever including, without limitation, negligence on the part of Scuba.Shop or its Employees, for any and all legal fees (on a solicitor and his own client basis) or costs, which may be incurred in defending any lawsuit or claim I may bring against them.

5. I appreciate that This Agreement applies whether Scuba.Shop is at fault or not and it limits the liability of The Employees to the same extent as it limits the liability of Scuba.Shop even though The Employees are not formal parties to This Agreement. I understand, further, that Scuba.Shop in securing execution of This Agreement by myself is acting as agent or trustee on behalf of or for the benefit of The Employees who shall to this extent be or be deemed to be parties to This Agreement. I have read and understood this agreement, I understand that this document contains a promise not to sue Scuba.Shop or The Employees and release and indemnify same for all claims.

General Terms of Use and Standards

The Scuba Shop

  • These terms are important and affect your legal rights, so read this and the other terms referred to in this document.

  • The following terms and conditions form the basis on which all training courses, dive reservations, merchandise, and services are sold and made by (“We,” “Us,” “Our,” “The Company”) to and with the buyer, (“You,” Your “), from Our websites (” the Site “), by telephone or personally in it Diving center.

  • These general conditions, our privacy policy, and every order form or payment instruction include the entire agreement between you and us regarding each sale, for example, a course or dive booking or rent diving equipment that we accept from you.

  • By booking through our website, telephone, e-mail, or in person, you agree to be bound by these terms and conditions.

  • If you book our services, you acknowledge that you have not relied on any statement, guarantee, or representation other than those in these terms and conditions. That includes our privacy policy, every order form, data form, form for medical statements, liability declaration, rental agreement form, or payment instruction.

Payments

Payments are made at the time of booking and are applied automatically to our reservations. At your registration/reservation time, the customer undertakes several commitments to the Scuba Shop. These include taking note of and agreeing with these Terms and Conditions for participation.
